PLEASE READ THESE MEMBERSHIP TERMS AND CONDITIONS CAREFULLY.
These terms and conditions apply to all registered members of LadyBlonde.com (the ”Site”) including LB2B membership and LB2C membership (“LBM”) whose registered office is at 2 Mountview Court, 310 Friern Barnet Lane, Whetstone, London N20 0YZ (“Member”).
Each Member agrees to abide by these Terms and Conditions.
When ordering anything from a supplier of products or services, you agree that these Terms and Conditions shall apply to your order to the exclusion of all other terms and these Terms and Conditions shall prevail over any other terms and conditions in any form whatsoever. All offers, gifts and services are also subject to their own terms and conditions – see individual offers for details.
1. MEMBERSHIP RULES
You agree to ensure you provide correct details when you apply for LBM and your failure to do so may invalidate your Membership. Your responsibility to provide accurate information is a continuing obligation and you must notify LadyBlonde.com in the event that any information provided by you changes. Your Membership is personal to you. You are responsible for ensuring that no one uses your Membership. Access to and use of the Member’s section of the LadyBlonde.com website ("Site") is through a combination of user name and password and is reserved exclusively for Members. You are solely responsible for maintaining the confidentiality of your user name and password and you agree to notify LadyBlonde.com immediately if you believe that there has been unauthorised use of your name and password. LBM is only available to persons over the age of 21. Any unauthorised or attempted use by person under the age of 21 will be null and void. All Membership applications are subject to verification and approval by LadyBlonde.com. LadyBlonde.com will notify you in the event that your Membership application has been accepted.LadyBlonde.com has the right to refuse membership applications without explanation. If a Member loses or has their LBM Card stolen then LadyBlonde.com should be informed as soon as possible and in any event within 24 hours. LadyBlonde.com reserve the right to charge a £10 replacement fee for each replacement Card. If your application to become a member of LadyBlonde.com is successful, you are entitled to select one joining gift when paying for your membership. Only one gift is permitted per members in accordance with the membership tier and each gift is subject to their own terms and conditions as available to view on the Site.
2. MEMBERSHIP FEES AND CANCELLATIONS
Current annual membership fees are shown on the membership page. Any increase in annual membership fees will be notified through the Membership page on the Site. Membership fees are due on acceptance of your Membership application and annually thereafter (“Renewal Date”). Membership fees are payable annually in advance by direct debit or payment by credit/debit or charge card of which we hold the details. Members authorise LadyBlonde.com to deduct renewal Membership fees by direct debit or any Payment Card up to 28 days prior to or on your Renewal Date. If LadyBlonde.com does not hold your payment details you will be contacted directly in order to renew your Membership. Your annual membership fee is non refundable. However, LadyBlonde.com may at its sole discretion elect to refund your Membership fee in whole or in part depending on the circumstances relating to the cancellation of any Membership. LadyBlonde.com reserves the absolute right to cancel or suspend your Membership (at its sole discretion) for any reason whatsoever. If LadyBlonde.com cancels your Membership, it shall refund the balance of the annual Membership fee on a time apportionment basis in respect of the unexpired period to which the annual Membership fee relates.
3. MEMBERSHIP BENEFITS
As a Member of LadyBlonde.com, you are entitled to all of the benefits and offers set out on the Site in accordance with your membership level. The descriptions of all benefits displayed have been approved by the relevant offer or benefit Supplier. As a registered Member of LadyBlonde.com, please note that Suppliers of benefits and the Benefits themselves are subject to availability and may change without notice. LadyBlonde.com aims to ensure that the benefits and offers remain available at all times and are constantly negotiating new benefits to ensure that you receive maximum use of your Membership. If any of the benefits become unavailable, we will do all we can to ensure that prior commitments are honoured to the fullest extent possible, but shall not be responsible for any actions of Suppliers outside LadyBlonde.com’s actual control. Members should always log onto LadyBlonde.com to view the further details of each offer to ensure that they understand all the conditions of any offer. The LBM Card can only be used where specified.
4. USING YOUR MEMBERSHIP
LadyBlonde.com reserves the right to withdraw any of these Services and/or to refuse to supply the Services requested. Suppliers are responsible for providing you with the services, products and benefits you select. LadyBlonde.com will not be responsible to communicate with Suppliers on your behalf, members are to contact the Supplier directly. Suppliers may impose their own terms and conditions and you are required to comply with these. When ordering or booking a product or service or accessing a benefit by telephone, it is essential that members inform them that they are a Member of LadyBlonde.com, and may be asked to give their membership card details and show their valid membership card on payment. When making purchases with our suppliers all members will be required to show their valid membership card and maybe asked to show valid identification. Failure to do so may result in failure to redeem the offer or service available for Members. Telephone calls to LadyBlonde.com may be monitored or recorded for training and quality control purposes.
You are deemed to be responsible for, and shall use your own skill and judgment as to, the quality, value and suitability of such information and suggestions in relation to deciding whether to enter into any contract with any third party for the supply of services or sale of goods. Your contract for the purchase of products or services is made with the relevant Supplier only. You agree that any contract entered into by you with any of the Suppliers is an independent contract. LadyBlonde.com hereby disclaims any and all liability for any act or omission of any Supplier or any loss incurred by you as a result of any act or omission of a Supplier. LadyBlonde.com accepts no liability for any losses or claims arising from any inability to access the Site or any failure to complete a transaction. LadyBlonde.com shall not be liable for any loss, cost, expense or damage of any nature whatsoever (whether direct or indirect) resulting from the provision of the Services or your reliance upon the information and suggestions provided by LadyBlonde.com hereunder and the resulting supply of goods and services to you by any third party. LadyBlonde.com shall have no liability to you for any injuries, loss, damage, costs, expenses or other claims for compensation arising from dealings with our suppliers. LadyBlonde.com’s maximum liability to you for breach of any of its obligations hereunder shall be limited to the value of the relevant annual Membership fee. LadyBlonde.com aims to ensure that viruses (or other programs having adverse effects) do not reside on the Site, but LadyBlonde.com accepts no responsibility in relation to this. This section applies only to the extent permitted by law.
6. CHANGES TO MEMBERSHIP RULES
LadyBlonde.com may vary these Terms and Conditions from time to time and will notify you of any changes in a timely manner. Notification can be by either Lady Blonde’s newsletter or The Site or by email or the post or other personal delivery service. Your continued use of your Membership constitutes acceptance of the altered Terms and Conditions.
LadyBlonde.com owns or is lawfully entitled to all of the copyright in this Site. All other intellectual property rights are reserved. This Site is for your personal use only - you may not use it for commercial purposes. You may only download to your personal computer for viewing purposes and print out a number of pages of this Site for your personal use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this Site.
LadyBlonde.com assumes no responsibility for the contents of any other website to which the Site has links and shall not be held responsible or liable for any loss or damages caused or alleged to have been caused by use of or reliance on any content, products or services available on such hyperlinked sites. LadyBlonde.com may not have control of such web sites. The inclusion of any hyperlinks to such other web sites does not mean that The LBM Card endorses the material on such websites or has any association with the owner thereof.
9. APPLICABLE LAW AND JURISDICTION
10. RESTAURANT BOOKINGS
This restaurant table booking service (the “Service”) is operated by Livebookings Holdings Limited (referred to in this Agreement as“Livebookings” “we”, “us” or “our”). Livebookings is registered in England and Wales under company number 5398578 and our registered address is at 5th Floor Elizabeth House 39 York Road London SE1 7NQ. Our VAT Number is 882 5959 65.
These are the terms and conditions which will govern your use of the Service, which is provided to you by Livebookings on behalf of restaurants in the Livebookings Network, either via the website of the restaurant with whom you are booking a table (a “Restaurant”) or via the website of one of our third party booking partners (a “Booking Partner”).
By using the Service you are deemed to have accepted these terms and conditions of use (the “User Terms”)
Please note that the dining services for which you book via your use of the Service are provided to you by the Restaurant directly and not by Livebookings. Therefore by using the Service to book a table at your chosen Restaurant you are entering into a direct contract with that Restaurant and Livebookings is not a party to that contract.
In order to make any booking using our Service you must have the legal capacity to do so and you must accept financial responsibility for all transactions made under your name. You must make sure that all the information you provide to us is true and accurate. Booking a table at the Restaurant means you have to pay the Restaurant after you have eaten unless it is clearly indicated before you book that you have to prepay in advance.
When you use the Service to place a booking at the Restaurant you are making an offer to the Restaurant to accept your booking. Your booking is not complete and legally binding on the Restaurant until such time as you have received a confirmatory email from the Restaurant accepting your booking.
If you wish to cancel your booking you can use the hypertext link in the confirmation email or contact the Restaurant directly. Contact details can be found in the confirmation email. Please ensure that you arrive in plenty of time and bring a copy of your email booking confirmation. If you have prepaid in advance please also bring the credit/debit card you used to make the booking.
Failure to attend the Restaurant at the reserved time may result in you being charged a "no-show" fee by the Restaurant. The decision whether to debit your card with a cancellation fee or "no-show" fee is entirely at the discretion of the Restaurant.
We reserve the right to cancel a booking, but this of course will be without any liability to you. We have, at any time for any reason without prior notification to you, the right to terminate or restrict, suspend or terminate your access to any or all of the Service if we believe that you are misusing the Service or if you are in breach of these User Terms.
Because your contract is directly with the Restaurant any queries or concerns that you may have in connection with your restaurant table booking should be addressed directly to the Restaurant via the details set out in the confirmatory email.
We reserve the right to disable your access to our Service and, where applicable, any user ID or password issued to you at any time if, in our opinion, you have failed to comply with any of the provisions of this Agreement.
In addition to these User Terms, your use of a Restaurant or Booking Partner website and the other services and products provided by Restaurants and Booking Partners in the Livebookings Network, may also be subject to any additional terms and conditions applied by restaurants and/or Booking Partners from time to time. Those terms will be in addition to, and therefore not a replacement for, these User Terms. Please ensure that you read such additional terms and conditions before using the websites and/or purchasing the services and products provided by restaurants and Booking Partners.
